March 4, 2012For those of you who have had lenders or real estate brokers force you to use a particular title carrier or agency, there is an interesting proposed ethics opinion you should be aware of. Proposed 2011 FEO 4 would make it unethical for a lawyer to base his or her decision on title insurance on factors other than what is in the best interests of the client. Specifically, a lawyer can not put his or her economic interests above the interests of the client. Let us know what you think. . .or better yet. . .give feedback to the State Bar!
